LLC Formation (Self-Directed IRA)

We appreciate the opportunity to assist you in the formation of a single-member limited liability company that will be owned by your self-directed retirement account. Due to the unique nature of a self-directed IRA LLC, payment of this firm’s flat fee as well as the Idaho Secretary of State’s associated filing fee must be made directly by the IRA LLC. This can only occur once funds from the IRA account are transferred into a newly created bank account for the IRA LLC. As a result, the majority of the work will be done before any such payment can be made. By clicking “Accept” below, you agree on behalf of the IRA LLC to be bound by these terms and promise to pay ANGSTMAN JOHNSON its fixed fee of $750.00 as well as the Idaho Secretary of State’s associated filing fee.
Forming a Self-Directed IRA is very similar to the formation of a single-member LLC. However, the sole-member of the LLC is the IRA and the owner of the IRA (you) will serve as the LLC’s manager. Once the LLC is operating, you direct the custodian of your IRA to invest in the LLC. This means that IRA funds can now be used by the LLC while giving you “checkbook control” of the IRA. As manager of the LLC, you will make all investment decisions on behalf of (and in the interest of) the LLC. While there are benefits to forming such an LLC, there are also regulations that must be followed that one of our attorneys will discuss with you.
